How messed up! The base of the problem of course lies with the nature of the internet iteslf. It is easy to grab images or cut and paste text and copyright protection is left up to the owner to persue and defend his property. For example, my avatar image, Pig Iron of the "Zoo Crew" is a copyrighted image of Scott Shaw! It happens that I have permission to use it, secured (on the forum) during his run on CBT with Oddball Comics.
If I understand it correctly, if he fails to reg the image with an outside registrar and or pursue his copyright then the image could be declared "Orphan"?

I'm confused (doesn't take much with legal mumbo-jumbo!).
Are they saying that as a non-US citizen, if I created "something", let's say a piece of art, that's covered by copyright laws here, that unless I register it in the US, it becomes "orphan" (in the US) and can be used however an individual (in the US) likes?

I do believe that is what it is saying.
The problem is the very vague language. Phrases like "a reasonable search must be done" WTF does that mean? "I googled it and couldn't come up with it so I used it...tough luck!"?
What will happen with this language and our court system is that large companies like Disney, Time Warner and others will be able to ignore copyright laws because if you try to fight back you will end up in court for the rest of your life arguing over vague terms.
This after Disney has already single handedly removed their own properties from public domain.
It sickens me.
Oh and don't forget now a poor schmuck like me has to pay to copyright everything he draws...unless I want it stolen and used by anyone who cares to.

US and copyright laws have always been This one sounds especially bad though and does make you wonder if its one of their political parties pandering to a large supporter (maybe Disney).
If I remember correctly Disney effectively stole some of Shoshtakovitch's work because he wasnt a US citizen or something.

I don't know that story but I don't doubt it. Disney is the most underhanded and greedy "creative" company I have ever seen. People hearken back to the days when Walt was in charge but that's only because they don't realize he did the same stuff. Walt didn't create one character in their library...and some he flat out stole. I hate Disney.
